The Seven Principals of Just Cause
When a Union Member is issued disipline, the Company must have 'Just Cause' to do so. Below are the "7 Principals of Just Cause" that every employer must meet in order to issue discipline or terminate an employee.
1. Notice: Did the employee know that they were in violation of a rule or regulation?
2. Reasonable rule or regulation? Was the rule violated reasonable?
3. Investigation: What took place during the investigation was there an investigation?
4. Fair Investigation: Was the investigation fair?
5. Proof: What was the proof?
6. Equal Treatment: Has everyone been treated this way in the past?
7. Appropriate Penalty: Was the penalty correct, did the punishment fit the crime?
